When using streaming platforms or subscription services, forgetting to cancel before the billing cycle means your plan automatically rolls over into the next month.
The same rule applies to residential leases in South Korea, whether it is a jeonse (lump-sum deposit lease) or a wolse (monthly rent). As the contract expiration date approaches, a landlord and tenant might neither ask to raise the deposit nor mention moving out.
When both parties let the deadline pass without speaking up, the law assumes that both sides want to keep the lease going under the exact same terms. In legal terms, this is called an 'implied renewal' (or tacit renewal).
There is no need to write a new contract or apply fresh signature seals. The tenant's right to live in the home is safely extended for another 2 years under the exact same deposit and rent terms recorded in the original agreement.
When is the deadline to prevent automatic renewal?
If you do not want an automatic renewal, you must clearly express your intention before the legally designated cutoff date. Under the law, remaining silent is treated as an agreement to extend.
For residential properties in South Korea, landlords must notify tenants between 6 months and 2 months before the lease ends if they wish to adjust terms or decline a renewal. Tenants who plan to move out must also inform the landlord at least 2 months before the contract expires.
If you miss this 2-month cutoff by even a single day, the lease automatically renews immediately. Explaining later that you intended to speak up but were too busy holds no legal weight.
Therefore, rather than relying on verbal conversations alone, it is crucial to keep verifiable records showing the exact date of notificationโsuch as recorded calls, text messages, messaging app receipts, or certified postal mail (proof of contents).
A closer look: Who holds the advantage after renewal?
Once an implied renewal takes effect, the law provides strong safeguards for the tenant, who is typically in the weaker bargaining position. The landlord cannot evict the tenant during this renewed 2-year term, nor can they arbitrarily raise the rent or deposit.
Tenants, on the other hand, enjoy significant flexibility: they can comfortably stay for the full 2 years, or they can notify the landlord to terminate the contract at any time if personal circumstances require moving.
However, the lease does not terminate the moment the tenant gives notice. Under the law, the cancellation takes effect exactly 3 months after the landlord receives the notice. This grace period gives the landlord reasonable time to find a replacement tenant and prepare the deposit refund.
Because the contract remains legally active during these 3 months, the tenant must continue paying monthly rent and maintenance fees. Only after the 3 full months have passed is the landlord legally obligated to return the security deposit.
